american disable and needs more- surg. on knee?

Dr. has requested a total knee Brickstreet Insurance denied the request which is Workers Comp for West Virginia what can i do? Brickstreet says not related to compensable injury but I have 3 operations in the past and they have been covered under Comp. 1987/1996/2008

  1. You need to contact a lawyer who specializes in workers compensation claims. If there is a question as to whether your knee surgery is related to your work-related injury, you have certain rights to a second opinion, etc. But it is complicated. Please contact an attorney!

  2. Not enough information to tell what the situation is. Is this a new
    work injury claim…? Just because there are prior WC claims and
    benefits paid does not mean this treatment is associated with those
    claims/injuries. If you are seeking treatment to a work injury now,
    you should file a new claim with this employer. If the prior claims
    were settled, and you took a lump sum payment, then you are
    responsible for further treatment to the body part you claimed in
    those cases/settlements. Out of your pocket. You can’t take money
    for future medical treatment in a WC claim and then have another
    insurance company pay for the treatment. Thats double dipping, and
    can be fraud. So, as I said… you have not provided enough
    information to answer your question. And, WHAT STATE are you in?
