Am i eligible for Workmans Comp insurance while on my 90 day probation period at work?

i hurt myself at work and it’s within the 90 day probation period, they are saying that makes me not eligible for workmans comp. but they are also very shady and cheapskates and i think they are lying.

they fired me right after they got the bill for the injury. and they don’t give 30 minute breaks. do i have a case? cuz the injury was only a sprain but i went to he ER cuz i thought it might be broken. and it’s probably only about a little over a thousand. just guessing.

but all combined do i have a case? and are they right about me not being able to get workmans comp insurance if i’m on my 90 day probation period?

  1. You are covered by worker’s comp during your probation period. Whether or not you are entitled to a 30 minute break depends on the law in your state. In most states, your employer would not be required to provide a 30 minute break for an adult.

    You should contact your state’s department of labor regarding the worker’s comp issue.

  2. What does a 30 min break have to do with your injury. And,
    employers must provide LUNCH breaks depending on the hours worked,
    restroom breaks wouldn’t generally be more than 15 mins away from
    your work station. YES you are covered for work injury from the
    minute you clock in. Your employer is wrong on this one. Benefits
    are STATE specific though..next time.. POST YOUR STATE
