Opening old Compensation Claim?

I am now 50, at age 28 I had an accident with a chain saw, cut along the side of my nose thru my eyelid, snapped my head back, wore a cervical collar, have had severe headaches ever since. When I went to court the moderator settled only on my facial scar, leaving the case open as the doctors concured that later in life I would have neck problems, which now I do. They left the case open. This was in NY State. How do I find out what the case number was for NY State workers comp and re-open this case, or should I just get a lawyer. I now live in Florida, would this make a difference?

  1. Your going to have to find your court order, which instructed any $ dispersed and any part of the case unsettled. Such as your neck. It’s going to take a little homework by you, or just retain a lawyer for a couple hundred dollars. Then you should be able to reopen your case, go through a battery of their doctors again, and get some kind of settlement. If there’s a substantial settlement possibility, the attorney just might represent you under contingency basis. Good luck
