Question regarding total temporary disability in California?

I was on total temporary disability because I have plantar fascitis on one of my feet and I was receiving workers compensation. Now workers comp is saying I was trying to defraud the system because they have me on tape going shopping (grocery store twice). My question is, was I supposed to stay home and not buy groceries, or things I need? Is this considered fraud?

  1. It might have been you told them you could only stand or walk for a certain amount of time and the video shows longer than what you said.
    Just guessing. Call and ask them.

    If you have an attorney, then let them know too.

  2. Either you completely can’t be on your feet, or you can, partially, be on your feet.

    If you were on disability because you claimed you couldn’t be on your feet to get to work and sit in a chair all day, but you were able to go to the grocery store, then that’s fraud.

    If you and your doctor told them you had to be completely off your feet, that includes work AND personal time. Clearly, if you’re able to get to the grocery store, you’re able to get to work.

My guess that a friend/neighbor knew about your disability and knew or believed you were not disabled and should not be entitled to FREE money, so they called and reported you, thus the insurance company getting video proving you are not disabled. Or even if no one reported, the insurance company if there are RED FLAGS about your claim, will watch you to see if you are truly disabled and should continue your WC.

    And yes this is fraud, since if like the others stated, if your disability is that you cant walk/stand for long periods or do other work and you are at the grocery store, getting out of the car, walking about the length of say 2 or 3 blocks without assistance, it implies you were lying.

    If you needed something, either a friend/family member could go and buy your groceries, or possibly have a wheelchair to use to get you around, that’s what people do when they are disabled, they get help/assistance.

    If you have a lawyer, better be on the phone with them.
