question about worker’s compensataion in California, please help!?

I was recently injured at work, and i took 6 hours off on the day i was injured and doctor permitted me one more day of rest. My employer has worker’s compensation, I was just wondering, should I get paid for that 6 hours and the day after?? what is the law on this. I think my employer is taking advantage of me not knowing my employee’s rights.

Any advices are appreciated! Thank you.

  1. It varies by state.

But by federal law, your state law rights are posted in common areas in your workplace. Can you read?

  2. WC does not cover lost wages until you have been off 7 days and doesn’t cover the first 7 unless you are of more than 14 days.
Most employers would pay you the 6 hours at the doctor but not the next day.

  3. Oh Anita…. shame on you. And, employment law is state issue,
before federal. ERISA is fed but doesnt have posting requirement.
Lynn, in Calif the first 3 days are not paid, if you are out 14
days the first 3 are picked up. If you are admitted to an inpatient
facility, the TTD is paid from day one. The only state that
requires the employer to pay the IW for time loss to treat the
injury is Connecticut. If your employer will permit you to use your
vacation time, or sick days…that’s how you would be paid for the
time you used to treat the injury. WC is no fault, both parties,
the employer and employee share in the cost of the claim.
