I have no Employees I am a one man show. I have a LLC but I am considered a sole proprietor. Would I qualify in the state of California to be exempt from this? Where do i go to get the form ? Can I download the form online?

  1. If you have no employees you are not subject to worker compensation unless you choose to cover yourself and pay into the w/c system. Many sole proprietor’s do not cover themselves due to the cost.

  2. YOu don’t need any exemption, you just don’t need any WC
coverage…you have no employees. Therefore, you have no liability
for industrial injury/illness. As you are responsible for your own
wellbeing, and medical care/wage replacement in the event of
injury/illness… you would be covered under your own health care
coverage. Wage replacement too would be your responsibility. WC
insurance covers the employer liability, the employee is not the
insured party, just the receipient of the benefits due. You are not
    an ”employee” as such.
