Overstayed immigrant?
A businessman from European Union overstayed his legal permission and by law he is an illegal immigrant for years.
He is about to file for I-485 and G-325A to change his immigration status.
His successful business is registered in the USA and he pays his and his legal employees taxes, social security, workers compensation, insurance, etc.
All his papers are legal, of course. The only issue is that he overstayed and looking for a way to legalize himself.
It will be on his record, but there is a fee he can pay to have it cleared off. Since it was years though, im not sure what kind of trouble he will get into.. sorry.
Not a question…
but that does suck for him….
I’d talk to a real lawyer.
On what basis does he think he’s entitled to apply for adjustment of status?
I’m sure if he’s such an successful business man, he can afford a lawyer, instead of asking other people to post this question on freaking Yahoo!Answers.
What is your basis for applying for permanent residency? Are you married to a US citizen? That’s the only way you might be able to make it work.
And yes, you should consult a lawyer.
You are wrong. The only issue is that you have been here breaking the law for years. Go home and take your cleaning business with you.
He better consult with well reputed competent immigration attorney to handle his case. He probably needs to file I-601 Waiver for his overstay. And Waiver is not something you can do by yourself.
He can only get over his overstay if his AOS is based on his marriage to a US citizen.
Running a business and paying taxes does not make up for overstaying the initial visa.
