Need advice on dismissing a Workers Comp lawyer from case?

After 2 years of fighting workers comp in WV, my attorney says its not feasible for her to fight for my medical. She just wants money. I have two treating Dr’s that say I have CRPS and in need of nerve blocks or is facing surgery again, I’ve had 3 surgeries on one arm. She tells me she will withdraw as counsel if I want her to. WC is stating I have reached my MMI, Dr’s disagree. How do I dismiss her and obtain new attorney? Any suggestions?
A attorney will not discuss a case with you as long as you have a lawyer hired. I was told you have to dismiss the attorney first, then consult another one. I dont want to dismiss her and not be able to hire another one.

Consult a different attorney before you tell your attorney anything about letting her withdraw.Sue the hell out of the workers comp and your attorney for giving up on you.You need financial support and medical for the rest of your life.If you settle and let your attorney withdraw ,you are screwed for life.Do not be decieved she is working for them.

  2. Your attorney is basically telling you she doesn’t think you will win. You may or may not agree with her, but do respect her opinion. Simply accept her offer to withdraw from the case and request a copy of your records be transferred to the new lawyer you choose.

    A new lawyer cannot discuss the facts of the case before they have those records (they ethically can’t go on just your statements). However, you can interview them to find one who suits your personality without dealing in case specifics.

    Finally, accept that the new lawyer may look at your records and provide the same recommendation as the old one.
