Labor Laws: Can salaried workers be forced to live at work without extra compensation?
I work as a refinery engineer in Jersey (surprise!) and the labor union is threatening to strike. The company has trained teams of salaried workers to replace the union workers. In the event of a strike, salaried workers will be locked into the refinery, but will only be paid for hours worked. Days will be broken into 12 hour shifts, with two teams alternating.
A third back up team will also be locked in, but only permitted to work 40 hours a week.
Basically the backup guys are going to be locked in like the first round shifts, but are not going to be paid extra and can’t leave on weekends or nights. Are there any rules in this area?
If it is an employee’s choice to be locked in, then where’s the problem?
If they’re forced to stay, then it’s considered wrongful imprisonment, lol.
Do you work for the Company or the Union ???
You could always get Sick…
I’m sure that you have been well compensated by your company, in part, for your loyalty. Your statement seem to push the idea that the company even “trained” you for this event.
Sounds like the lock down would be for your own safety, and I doubt it would last a very long time….
In any case … you can always quit.
the company can’t force you to do anything against your will. you are free to do what you want while off the clock
