I have a legal question, please help me.?

First let me tell you that I live in the state of Georgia. 6 years ago I was hurt on my job. I fell and tore my rotator cuff and hurt my neck. I have already had shoulder surgery and I getting ready to have neck surgery. Know here is the legal question. My attorney says that I can not sue the workers comp people for Pain and Suffering. At first the company didn’t want to pay my doctor bills at all. The reluctantly agreed to pay after I got an attorney. So my question is now what. I have been in pain so long that know I have to take an anti-depressant and I have to take pain killers everyday. There is not a day that goes by that I am not in constant pain. I have a 2 year old and I can hold her, pick her up, or other things mommy’s do. I can not vacume, iron, mop, or other house hold chores. My husband loves me but I am always in a bad mood. I am in constant pain so now what? Please give me advice. Thanks

  3. ONLY an attorney is qualified to give Legal Advice. I am not an attorney, but do have over 20 years workers comp experience. From what I know right now,
    Your attorney apears to be CORRECT that you can NOT sue & recover for Pain & Suffering in workers comp. BUT – it is NOT clear HOW or WHY you fell. IF there is a potential 3rd party who may be legally negligent for the reason WHY you fell, then you MAY be able to recover via the responsible third party. There is not enough info for me to tell.
    Ask your attorney whether your injury qualifies as a Third Party injury.
