Hubby broke his finger at work, workers comp accepted claim, and now they “found” a reason to fire him…?
I need help! What do I do?
My hubby broke his finger at work. Workers comp took responsibility, turns out he has partial permanent disability in the finger now…they said they would like to settle for it. great, what is a good settlement amount for Oregon workers comp claims?
OK HERES THE KICKER…
this happened 3 months ago, he hurt his back (workers comp again, and they accepted claim) that was 1 month ago….and today they said my hubby has a bad attitude and FIRED him….he doesn’t have a bad attitude, i think they were making up reasons….
WHAT DO WE DO NOW? IS THIS SOMETHING WE SHOULD HIRE AN ATTORNEY FOR? my hubby feels like he was fired because he got hurt…not because of his attitude.
Yes, you need to hire an attorney. Check with your local bar association for attorneys who specialize in workers’ comp cases.
It sounds like you probably do have a case. Unless of course your hubby has been written up in the past or suspended or anything of that nature. If he has a clean work record…he probably got screwed, and you should call a lawyer.
I am not saying this is same as your husband’s case but.
We had an employee that put his hand into a machine that was running and broke 2 fingers. Workers Comp paid all medical, including surgery, etc. He came back to work.
1 week later, he sprained his ankle walking over a conveyer that was moving. Another worker’s comp claim. He came back to work. He was stopped just before another accident happened and he was fired.
He was an unsafe employee. The injuries he received were his fault for not following the posted safety precautions and/or common sense. He was a liability. After his first injury, he did have a bad attitude. He thought the company owed him something. He didn’t want to work. There was always an excuse. He had to go. He tried filing a lawsuit and it was thrown out. He tried to find another attorney but no one would take his case.
