Do I need an attorney ? Legal Question Posted !
I worked for a Company on a federal job. The job fell under Davis-Bacon Wages.
First :
I got my ankle crushed on the job. I had tendon damage
( tendonitis ) nerve damage, cartilage damage, can barely move by ankle side to side. I have been in physical therapy 3x per week for 5 months. My foot goes numb, turns colors, and hurts all the time. I have been under Dr care since the accident. Workers Comp sent me for two Independant Medical Evaluations. Last time, ( their ) doctor said they couldn’t find anything wrong with me. I have 3 doctors who say there is. How can I find out how much damage my ankle really has because according to the IME, Workers Comp is going to want to settle ?
Second :
After the accident, I was contacted by the company ( about a week and a half ) I was asked by the owner if I turned the accident over to Workers Comp. I told him I had and he told me that I was laid off. He sent me a layoff slip. Is that against any law?
I am a Heavy Equipment Operator and I need both of my feet to operate the equipment. My ankle is so bad that I can’t walk on it for longer than 15 – 20 minutes. My doctor talked about surgery and scoping out the cartilage in my ankle.
How does Workers Compensation work in regards to settling a claim ? I need my medical benefits due to future medical procedures.
It seems like the IME said I had nothing wrong so he could clear Workers Comp from paying future medical bills OR to settle the claim for a little bit of nothing…
I need opinions on this situation. I am out of work now. I have been under doctors care for several months, and the company laid me off due to this injury.
Yes sue their pants off you have a case. Some attorneys will take it on without money up front .
Yes it is wrong but not against the law. He does have to keep paying your wage as long as you are injured and deemed disabled. You have laws protecting you. Once you are released though and he terminates you, it’s legit.
I don’t know if they can terminate you for that. But I do think you have a case. My fiance was injured and they ignored a part of it, no matter how much he complained they claimed it couldn’t have happened in the accident. He contacted a workers comp lawyer (who you don’t have to pay by the way, it comes out of a fund for such things) and he was sent to a doctor. He needed surgery and of course workers comp doesn’t want to pay. They too sent him to independent docs who said there was nothing wrong with him. He just had his last appt and he may actually get something now… it’s not an open and shut thing — they WILL fight you, but that’s what your lawyer is for… Good luck!!
Short answer; in a situation this complex, you certainly need an atty.
Your employer can lay you off and there isn’t any thing you can do. My husband went through the same thing. WCB should retrain you for an occupation that you can do or give you a pay out.
You need to contact an attorney ASAP. You won’t need any money-after they hear workers comp is involved they will take your case. From your question that you posted you have a very good case. Look for Workers Comp attorneys in your area. You don’t have a lawyer and they are taking advantage of that. I work for a workers comp lawyer that works for the insurance company of the employer. I’m telling you, you don’t have a chance without an attorney.
Yes, you need an attorney, the reason I say this is America appreciates when you spread the money around. Not only that but if you need to ask this question, then there may be other things that you cannot even imagine how WC will come at you.
2) With WC on most cases each part your body has a monetary amount. That is what you can get.
3) If you can prove what you said about the firing, uuuh yea, you may be able to get compensated for that. Good Luck.
4) Oh and your attorney can send you to a doctor-a specialist-that knows about that sort of injury.
