Anyone ever deal with workers comp?
I was told by my attorney yesterday that I have a meeting with a vocational rehab councilor in the near future. Can I assume this is an attempt by my employer to avoid a settlement? My doc has put some pretty stiff restrictions on me limiting my ability to sit, how do they expect me to sit in a classroom?????
My disability is permanent, my restrictions are permanent, and are documented by my physician. I just find it odd that WC expects me to sit or retrain for anything with these restrictions, it’s very painful.
Yes the insurance adjusters are making their case against you, but i wouldn’t worry about this to much because you still can get a written letter from your doctor stating that your fiscal disabilities want allow you to sit in a class room for a long period of time . These thing is just a formality your lawyer should be on top of this also.
Workers Compensation would probably like to see if you can be rehabilitated. If you can be, then they would have to pay less to you in the long run, because your injury would not be considered permanent. If you do not show up – or refuse – then they can stop payment all together.
You are dealing with a government agency. You are required to see their doctors, not yours. If you fail to meet the requirements, you will be disqualified from benefits.
Meeting with a rehab councilor has nothing to do with your employer.
Your employer has nothing to do with any settlement.
The insurance compnay’s atorneys don’t work for your employer. Any settlement would have to be approved by the workers compensation board. The workers compensation attorneys can make an offer of cash settlement but, they will want to see your percentage of disability at the lowest possible point.
It’s the workers compensation insurance attorneys and the workers compensation boardthat have probably determined that you can be retrained for other employment that would take you degree of disability into account. The rehab councilor will asses your disability and make recommendations for options to rehabilitating you for employment.
During any rehabilitation, your workers comp payments will not change. You will receive funding for any schooling and be reimbursed for transportation costs to and from rehab. Rehab does not necessarily mean you will be sitting in a classroom. It may be that an on-the-job training program may fit your restrictions.
Any resistance to rehab may be considered an attempt on your part to extend your disability for monetary reasons and the workers compensation board judge will and can suspend your payments.
Workers compensation never pays more than a real job will. I would think that you would look forward to finding a way to work, through rehab.
WoW what lack of understanding or real knowledge of WC or how the
system works. You are being offered an opportunity to attend VR
because your Dr said you cannot return to your preinjury job
duties. You don’t have to participate in a VR program, But the
employer/carrier doesn’t have to continue to pay your wage loss
benefits either. You are receiving TTD/temp disability payments
until your Dr has determined you can perform some type of work,
whether this is pre injury capacity or other gainful employement
even sedentary. Pain is not a “disability” lots of people do some
kind of work every day with “pain”. WC does not go on forever
unless you are determined 100% DISABLED under the rules. You better
get in your mind that you will be returning to some type of job,
whether you like it or not. Your comp benefits are going to end at
some point-, probably sooner than later. If you would provide your
STATE, it would be easier to give you relative information to your
situation.
