Work injury Can i sue?
I got injured at my old job. they gave me a weeks workers comp. it injured my armed had an ac joint spereation. Doc said it would be a life injury and get worse over time. Hes one of the best doctors in houston. Its been a year and i cant hardly use my arm anymore like i use to before the accident. Can i sue?

  1. You need to hire a worker’s compensation attorney. You cannot sue under worker’s comp. You may be entitled to an award because of your injuries, but the amount of the award is usually much less than what you might get in the same accident but out of the workplace.

  2. No. You cannot sue the employer. WC is the exclusive remedy. You
    are not compensated because of the loss of ability to function as
    you were pre injury. WC benefits are pre determined, and set by
    law. TX WC is unique unto itself in the way the system works, and
    benefit provided. You dont need an attorney in TX comp…there are
    no “settlements”, only benefits.
