work comp- been treated for a year and now been told that injury isn’t work related?
i hurt my whole right side last year in september. i was told it was cervical & lumbar sprain. now they are trying to tell me after all this time it isn’t work related. my initial injury report the whole right side of my body was circled as it affected it all and still does. but since my back pain isn’t related to my shoulder pain they are trying to get out of the injury. mind you they pay for the meds. i am wondering what is up? planning on getting a lawyer. any other suggestions? this is the first time i have delt with work comp.
my employers insurance company said that it isn’t work related. i understand where it can get confusing. the lumbar is your back. i have been to my dr. , an orthopidic dr (sports medicine and this type of injury). i have seen a pain management specialist also. then the insurance co sent me to a separate independant dr for his oppinion. the last dr who i seen is the one that told teh insurance company. it isn’t work related.
Yep, consult with an attorney. The sooner the better. But I’m confused on what you ment by cervical & lumbar sprain not being related to shoulder pain. The neck is connected to your shoulder. So how can it not be related?
Who is saying it isn’t work related? Your employers insurance carrier or what?
I would definitely consult with an attorney. You can also get a second opinion by a 3rd party doctor.
your insurance company sent you to a doctor on their payroll, of course he is going to tell them what they want to hear. Go visit a 3rd party doctor and get a 4th opinion since you already have 3.
The biggest question would be how did you hurt your back?
No one is questioning your injury. Only that it happened in the
course of performing your job duties. The IC cannot make the
medical determination, only a Dr can. Thats’ why you were evaluated
by an IME. IME’s don’t “work for” the IC as on their payroll. That
is not true. You didn’t provide your state, but WC laws are state
specific. There are provisions in ALL states for resolving disputed
medical issues. You will have to file for a hearing at the WC
court, and a judge will make the final determination to
compensability. In the meantime, your weekly benefits are going to
stop. Get legal advice from an atty…not a message board.
