Im wondering because I injured a shoulder on my current job but they(the doctor Im seeing via workers comp) are trying to pin it on my prior injury to that same shoulder 7 years ago which was non-work related injury(so I didnt go to a doctor). What should I do? And will they pay for a surgery?

  1. They have to pay only if the performance of your duties caused an exacerbation to the previous medical condition.

  2. It is the traditional workers comp, preexisting injuries may not be covered if it is proven that the current injury is not job related.

  3. You only go to a doctor is the injury is work related, but if you
fall off a roof at home and hurt your shoulder you wouldn’t go to a
doctor? The prior injury could be cause of permenant disability
when you are rated once you are MMI from treatment to this injury.
What that means is… a PD rating to this injury would be reduced
by a % as determined caused by the prior. Even though it is not a
work injury. That % will reduce the money/settlement from this
claim. You are required by law to tell about all other injuries you
may have suffered in your past.
