What can I do if I had a work injury at Sonic? Can I sue anyone?

I work at Sonic. I am a carhop, and when I was taking some drinks out I slipped and landed on by back it hurt pretty bad. I slipped on ice that froze because the side of the building leaks water. Now 2 days later I have to go to the ER because of the pain. Help Please!
Well see as soon as the whole incident happened I told my Supervisor and she asked me how it happened and they went to check were it had happened but i felt like they didn’t care the rest of the night i was in pain and they knew it but i feel like they didn’t care and now that im having pain and have to go to the ER they want to me find somebody to work for me. even if i am hurt. one of my other mangers saw me fall.

  1. No, you don’t sue. You immediately notify the employer of the injury and file a Worker’s Compensation claim with the employer.

  2. Did you report it to your supervisor? If not you end up hurting any chances of a law suite. You need to report it so that they pay for all of the bills and do the best to help you out. They have to have the chance of helping you out. You just can not fall down and decide to sue. They have the workers comp insurance to take care of the medical, and then you could get on disability insurance after awhile while you recover.

  3. First hopefully you informed your supervisor. If not tell them now and your hurting and need to see a doctor. If you don’t get help from them it’s time to see a lawyer who works on workers compensation cases. It’s a little long process but it helps good luck.

  5. I worked at sonic for years and have seen so many accidents happen like that and no one has tried to sue them. They have to fill out an accident report you go to the hospital and pass a drug test. If you pass it they will pay for all you doctor bills. If you are really wanting to sue then seek a lawyers help to see if anything can be done about it. I tell you sonic is such an unsafe place to work.

Notify your boss about your injury asap and the manger will take steps to have a workers compensation claim made, you will need to tell the hospital admitting that it was work related to Sonic otherwise you will receive the bill’s in your name, if you miss any work because of your work related injury you are entitled to be compensated for your lost time…..

    It is important to notify your supervision immediately after an accident, so that the company can work to help you get better..

    where I work, if you do not report your injury intermediately, and you do report it later, they still will proceed with the workers compensation claim, but when you step back on company property all healed, you will be let go, for not reporting an injury in a timely manner..

  7. You should have told them RIGHT THEN that you had fallen, so that it could have been documented…call your work now and tell them when you fell, and that you are on your way to the E-R because of the pain from the injury…

    Tell the E-R people this will be a Worker’s Comp. claim…they have to mark all the paper-work that way….I have been through this, because I had a car accident while driving to a meeting for my company (not caused by me) and I have been through this mess…

    Write down all dates, times, where you were seen, doctors’ names, in a notebook for your own records, and every time you talk to your work, write that down, and every time you speak to a Worker’s Comp rep, write down their name, the time and date, and summarize what the conversation was about…

    They can seem like your best buddy, but they are out to trick you, reduce payment, or take something you might say innocently and twist it around to prove that you are not injured, or are less injured than you claim.

    The best advice I can give you is to keep things business-like and professional…when they ask how you are, never, ever say FINE! Instead, turn it back to them, “How are you?” or say, “Well, I’ve certainly felt better than I do right now.” In court, “fine” can be construed as “NOTHING IS WRONG WITH ME!”

  8. In the u.s., if you are injured on the job, your sole remedy against the employer is workers comp. You do not need to show wrongdoing or negligence, just that you were injured on the job.

  10. File a claim for WC benefits. Doesn’t matter what your supervisors
    think or feel. Why are you taking into consideration they didn’t
    “care” about your injury? You are the one responsible for seeking
    treatment, not your employer. You file the claim, get the treatment
    necessary, and the employer files the claim with their ins carrier.
    You dont’ sue your employer. Benefits under the WC rules are your
    exclusive remedy. No money for pain and suffering, punitive damages
    or lost wages beyone the TTD/PD you receive in the claim.
