There are no “rights”. If you are injured while not working, you
seek treatment on your own, out of pocket or using your own group
health coverage. If you are asking about job protection… IF you
are eligible for unpaid leave under FMLA, your job and associated
employer paid benefits would be protected up to 12 weeks per annum.
Beyond that… unless there is a CBA/Collective Barganing
Agreement…union contract inplace that offers additional job
protection… the employer is not required to save or create a job
for you once you are released to return to work. What is your
