If you are on workers comp for a work related injury?

If you are on workers comp for a work related injury can your employer fire you?or lay you off? If you were put on light duty, and sent to another department to workon light duty. The workman”s comp has not filed off on the case yet I’m still under a doctors care for the injury.

  1. As long as it wasn’t retaliation for the WC claim, probably yes. of course, most employers are too scared of a retaliation law suit to actually do such a thing.

  2. Bull… employers file people all the time.. retaiation has nothing
    to do with this. It would be the IW how would have to prove there
    is any discrimination. If you are eligible for leave under FMLA,
    you should request that now. FMLA provides up to 12 weeks of job
    protection including employer paid benefits. Don’t know what you
    mean by not “filed off” on the claim yet…? The claim is open
    until you are paid a cash lump sum to close out everything and
    agree not to come back. YOu also agree to pay out of your pocket
    for any additional treatment if you take the cash payment.
