I was wondering if I can reopen the case cause I feel that I should have sued the company for what had happened, can I re-open the case and do this? Or is there a statue of limitations?

  1. You waived your rights to further negotiation/compensation when you signed the papers that their lawyers prepared.

  2. Too late. once you accepted the settlement, that’s it. unless something else happened as a result of this injury after the first settlement, You can’t possibly win any thing more.

  4. You are limited in WC to filing a claim for benefits under your
employer plan for industrial injury. That’s called exclusive
remedy… you cannot sue the employer beyond that. As you accepted
the lump sum payment, you agreed to drop any further claim for
benefits. You cannot expect to go back this many years and claim
more money because you changed your mind…since 1993 !
