I fractured my wrist due to work related Injury? should i get compensations? any legal advises?

i was injured about a week ago while i was at my job. I work as an airplane cleaner for a contractor at an airport. On the night i had the accident i was asked by my manager to push a trash cart, but i refused because it was too heavy for me, but the manager ordered me to do the job anyway because i was on my shift and to do it anyway. So as i was pushing the cart i fell down and broke my wrist. the roads were icy and there was snow on the ground.

So i was taken to the emergency room and the emergency room doctor said he couldn’t see any fractures, but advised me to see an orthopedic doctor if the pain doesn’t go way in a couple of days. so today i just seen the orthopedic doctor and he said i had a fractured wrist bone. So he put cast on my arm and said i can’t work for the next six weeks. My Job has been covering all the medical costs since the accident happened.

should they pay me for the six months i am gonna miss? is there any other compensation i should get or ask for? and how much benefit would i be able to get?

  4. Six weeks you mean, not six months. If you are an employee here in the U.S. you are probably entitled to Workman’s Compensation. This is a program that you employer pays into…or should be. You can then receive a portion of your normal wages on which to live in addition to them paying all your medical expenses for a work related injury. Contact their human resources department if they have one. If not, contact an attorney.

  5. Yes, in the US under worker’s compensation lawyou should get paid for the six weeks you are out of work, as well as your medical bills. Not much more then that, though.

  6. Welcome to the world of workman’s comp. I’m assuming you didn’t have any disability insurance, so, depending on the laws in your state, we will use mine, after you are out of work for 2 weeks you get a check from workmans comp, it’s not much, kinda like unemployment, your employer still pays all the bills for your medical cost and IF you have permanent damage, you can receive a check for it based on a formula they have. Problem with how the accident happen is it’s going to be your word against his, with nether having proof.

  7. Get in touch with a personal injury/worker’s comp lawyer. You should be paid 2/3 of your salary for the next six weeks, plus temporary total disability (depending on the extent of your injury, it could be more than that).

  9. It doesn’t matter whether there is proof of the injury, WC is no
    fault. Niether party is charged with providing there is an
    injury… only to the injured worker in proving eligibility to the
    benefits being requested…medical treatment, and wage replacement.
    Only IF there is peremenant disability/impairment due to this
    injury would there be an award of indemnity. There are NO
    “settlements” in WC. Only benefits paid based on the laws of your
    state. As you did not provide your state, there is no further
    information you can be provided here regarding the potential value
    of your indemnity if any due. You won’t know that until you have
    recovered sufficiently to be declared MMI, and rated.
