How much is my lawsuit worth. How do they put a price on a permanent injury?
I was involved in a accident with a NJ transit bus. He cut in front fo me and I hit the side of the bus. He got a ticket and this is his 3rd accident. I had back surgery for a burst disc.
My doctor ‘s report says I have a permanent injury and he signed a cert. of perm. I was out of work for 6 months and still have pain everyday. Every morning when I wake up I know I had surgery. I have a six inch scar on my stomache and two 3 inch scars on my back. How do they put a value on a permanent injury. I have 2 small boys and I am 41 years old.
If his insurance company doesn’t offer you a satisfactory settlement and this has to go to court, then usually the jury decides what it is worth so you have to gain their sympathy. Bring your children to court…if it gets that far.
Multiply your health expenses by 3. 1/3 to your lawyer, 1/3 to your health fees an 1/3 for for you for pain and suffering.
Your claim is valued at medical expenses, lost wages, scarring, pain and suffering, permanency, substitute services (maids, specially equipped vehicles).
The value of the permanency is estimated loss of future earning power.
Your claim may be worth millions. Unfortunately, I don’t know NJ laws. In PA the limit of liability on a political sub-division is $500,000. So you could not make a claim for more than that amount.
I suggest you consider hiring an attorney and pay him a fee to help put a dollar value on your case. If the transit authority is going to agree to settle, you don’t have to hire an attorney on a contingency basis to pursue the claim for you.
