has anyone taken their employer to court for an injury?

I tore my acl and meniscus at work, ended up getting fired. I was wondering if anyone else took their employer to court for the same type if injury and how much they were awarded

  1. Not taken to civil court but filed a Workman’s Compensation claim.

  2. That is a Worker’s Compensation case, not an issue for the courts. If you are injured at work, for any reason, you are entitled to payment for your medical costs plus lost wages.

    this is complicated but the way the law works you have to file workmans comp claim. then after certain conditions are met you MAY be able to sue.

  5. Filing a claim for WC benefits is the exclusive remedy in all but
    the rarest circumstance. Generally, your employer would have to be
    without legal coverage for work injury to sue in civil/tort courts.
    It would be helpful if you would provide your STATE… WC laws are
    STATE SPECIFIC… answers you get on a message board are generic at
    best. BTW… there are NO other persons who have suffered the same
    injury, the same circumstance, nor would receive the same PD
    rating, or award in any settlement. DOn’t make comparisions to what
    other injured workers may have receivied. You’ll be sadly
    disappointed.
