Can your employer force you to reveal why you were off sick from work?

At my job we have paid sick leave. The employer requires that a sick form be filled out upon a return to work. The employer rejects the sick leave form if you do not state what type of sickness or injury.

  1. Yes, some even require a doctors excuse. It is sick leave and not personal time off.

  3. If they are giving you PAID time off to recover from an illness or injury, they want to make sure that they aren’t paying you to go to the beach.

    Fill out the form properly, and be thankful that you have an employer that allows you to take off sick. Many places won’t give paid sick leave, so someone will come in with a cold or bronchitis, infect the whole workplace, and then all the workers take the sickness back home to their families.

    Sure he can work is a ” A twill” In other words you can leave for any reason and they can fire you for any reason. What does it matter if you dont have anything to hide

  5. Not they can’t. They may tell you different, but when push comes to shove they will back down. Due to recent privacy laws they can not make you state the nature of your illness. If you have a note from your doctor saying you were too ill to work, that is all you legally need to give them. If they press the issue, threaten to get an attorney.

  6. If you want to get paid for the time you were off sick, then yes …… he can force you . If you DON`T want to be paid for that time off work , then simply disregard that particular question ………. because your employer can`t FORCE you to answer it in that case !

    No employer is under any legal obligation to pay you for sick time off from work !!

  7. Not positive. But I believe that you’d only have to provide a doctor’s excuse in the event you were off of work more than two, or three days. Depends on where and what type of job you have. It also may depend on how long you’ve been working at your present job.

  8. Yes, they can. They have the right to know that you are not abusing the benefit, and just taking a sick day to go shopping or to the beach in the summer.

    of course, you have the right to not provide this information. But doing so will also probably mean youi don’t get paid for that time off.

  9. They can ask for a doctors note, but they cannot ask what the illness was. This is an invasion of privacy. The Doctor will not reveal the reason either because of Hippa laws. Didn’t any of you watch the movie “Philadelphia” with Tom Hanks. You can not discriminate based on a persons illnesses.

  10. If you are covered by FMLA rules, the employer CAN and DOES have
    the right to know what the compelling medical reason is for your
    absence. And, CAN require a release though medical evaluation for
    your return to work. Under FMLA however, the injury/illness/medical
    condition need not necessarily be that of your own… Just
    cooperate with your employer, and be appreciative you have a job to
    go back to …many many people don’t.

  12. Im off work for a non work related injury, my FMLA and STD, will
    eventually run out around the end of Nov. 2010. My question is can
    they force me back to work even though I turned in a note from the
    Dr. to stay off until Jan. 30th, 2011
