can my husband be suspended from work if he is out on leave for an injury that occored at work?
Ok this is what happened, my Husband got hurt at work he was off my medical excuse. His part time job had called him and asked if he would go in and VERBALY explain a procidure to someone. He agreed. He was NOT compinsated for his time nor on the clock. His boss from his other juob had came in while he was there. His other job then tryed to fire him for being out on workers comp but working at his other job. He was NOT working it was done on his OWN time. There was a hearing (union) for this. He would say he won, his boss from his part time job did conferm he was NOT working. His boss from his full time job then changed his story and said my husband never turned his excuse in and wanted him fired. Because it is union they have to have a hearing. But my question is CAN his job suspend him if he was already out on leave and workers comp??????!! We live in pa if this helps. Please let me know if you find anything and were you found it.
There is nothing left out of the story, your right his boss from his union job is out to get him we dont know why.
His boss from his union job changed his story once he was laughed at because my husbands boss from his part time job wrote a letter stating my husband was not working.
His union boss then said well he never turned his excuse in for being off and suspended him “untill termenation”
My husband did nothing wrong! He called his boss and let him know he would be off he had his excuse and his boss said that was fine just bring his excuse when he was aloud to return. Can he really be suspended? Will he get his back pay because his boss is F-ed in his head.
he cant get in trouble if at the second job he does not do the same thing if he’s off for some physical reason from the first job. but the boss will have to prove that he was working and if he really was not working at that time then the second boss would have no problem telling the truth if he was asked. If he is on workerss compensation then that means that the paper work and everything was handle at work so his boss would know already. I think that your husband is not telling you the whole story or your leaving something out.
If it is him who got hurt at work and it is by fault of his place of work, he should just sue them, and if they suspened him for something that is there fault he should DEFINITELY sue them.
His boss from his union job is screwed. The Union should fight it tooth and nail. It is perfectly obvious that the man is out to “get” you husband. One question, What was his Boss doing at your husband’s part time job. Why wasn’t HE working. I would think that would be an issue for him. Does the boss’ supervisor know he was gallivanting about the countryside when he was supposed to be working?
Talk to an attorney handling workers compensation claims, and maybe
a labor law atty. A message board is not a good substitute for
valid legal advice. There is no fee for a consultation in WC.
