Most places of employement can and will lay you off or fire you if you are not able to preform certain work duties. Legally you can fight it if you can prove that their are other jobs within that company that you can work. Also if you hurt yourself at work most of the time they do let you go due to any legal lawsuits they may have against them. I hope you don’t work for Walmart.
He shouldn’t be able to. But actually my buddy at IBM had a health condition, surgery, with Dr. notes, yet he still missed a bunch of time. Then, come review time, they say he never met his quotas and was absent a lot and fire him. He hires atty. gets 6 months pay out it which went to the atty. Bottom line, just be careful, anything could happen.
He cannot fire you if you have a letter from a doctor stating that you need work restrictions. You can sue him for that. They have to accomidate you because you were hurt at work. They would have such a huge lawsuit if they fired you. If it was a work related injury, they are obligated to do whatever is necessary to make working for you easier on your knees, and they have to keep you on work restriction until your doctor releases you to zero restriction.
most often he can not, you should have filed a workers comp claim
Just because of restrictions, your ER should not terminate you. Go
back to your treating physician and tell him/her your ER cannot
make the reasonable accommodation for light duty, and get returned
to a TTD status. As you did not provide your STATE, and WC laws are
state specific, the best advice is to talk to an attorney. And, go
to your state web site for WC benefit/rules information.
