can I sue the salvation army after receiving a brain injury in their rehab?

While performing “work therapy” in a warehouse at the salvation armys adult rehabilitation center I received a traumatic brain injury. I now have seizures, severe headaches and require 24 hour supervision. can i sue them for negligence among other things?

  1. Sure you can sue. If you can win or not depends on the details of your case. You will need a doctor that is willing to say that what ever happened there caused your issues and you will need a lawyer to help you prove that they caused the situation.

    If you were covered under Workers Compensation then that is the exclusive remedy.

  3. Only if you can proove that they caused your injury or knowingly ignored something that caused it. You’d also have to proove your seizures are from the injury and not from your past substance abuse. You’d have to proove that you did nothing to contribute to your injury.

    In this society, anyone can sue anyone for anything…the question is, will you collect?

  4. WRG has it right here. Filing a claim for benefits under their WC
    plan is your exclusive remedy…IF you were paid as an employee. If
    you were part of a Vocational Rehabilitation program supplied by
    the SA though a insurance carrier, or the State, you should consult
    with a personal injury atty, not a message board. By the way, you
    are doing pretty will posting here, after finding this board…
    particulary with a TBI as you describe. Or is someone posting for
    you ?
