can i sue a job for possiable internal bodily injury, during work due to miss use of non approved company chem?

i use to work @ denny’s, and one of the managers brought in a chemical to clean stainless steel called sheila shine. ( look it up and look @ the material safty data for what can happen if ur not protected from the chemical) well one manager instructed me to pour the cleaner on a towel and began wiping down the stainless steel in the mop room. ( one doorway no vents that i can remember) once u read the material saftey data sheet compare my symptoms. shortly after use when i would go #2 i would always have blood on the toilet paper, when i wiped and it dissappered for a little while but is now back and now every morning when i wake up my nose has bloody boogers in it. and no i dont do drugs. can someone help[ me out. cause if this is a ligit case i’m going 2 take them for all they got because thats my life they are messing with

  2. The first thing to do is prove the symptoms you have were caused by the cleaner. That is where your problem lies with this case. You do not say how long ago it was that you worked there. There are many things that can cause your symptoms. See a doctor then if he agrees you consult a lawyer.

  3. You cannot sue your employer. Your filing for benefits under the
    employers plan for industrial injury or illness is the exclusive
    remedy. There may or may not be legal action available in a 3rd
    party claim. IF you are successful in recovery in a 3rd party suit,
    your employer/WC carrier would be entitled to reimbursement for any
    benefits they may provide. You are not going to “take them for all
    their worth” in a suit against your employer. Talk to an attorney
    handling Workers Compensation, and personal injury claims.
