Can I receive any benefits (income) from an injury obtained outside of work? I need to take time off work.?

Here is the story:

While walking my son to school, I got hit by a car. I fractured my neck and my back. I’m in the process of hiring a lawyer to sue the person who has hit me by the car.

Because of all the dr. appts, I have to take off work.

Is there anyway I can receive benefits from my job? Workman’s Comp?

Basically, Is there a way for me to receive some type of income?

I need help fast.

  1. No. If your employer will not work with you, and you have no sick days to use, you would have to take unpaid leave now.

You will be able to get the lost wages back in court later (when you sue) but you will be out the money for right now.

  2. Possibility Disability or Unemployment if you cannot work because of no fault of your own.

  3. Ask the lawyer.

  4. Depends on what state you live in. There are about 6 states that
have a disability income program. Otherwise, your wage replacement
would be dependent on whether or not your employer has a STD/LTD
policy of coverage on you. Check with your employer. You do NOT
qualify for Workers COmpensation…those benefits are paid for
injuries/illness that occur in the course of your employment.
