Question by Terron C: should i sue the military?
I signed up for the USMC of 06′. during training i was hurt causing me to have really bad head aches. I was given a medical discharged even though I didn’t want to to go home. before i was left i was told that i will get 3 free months of medical care at my local V.A. according to the Marines that did my paper work. However; i didn’t not receive my medical care. My friends and family have all told me that i should sue and it’s something that i never wanted to do… until i was in subway last week and while i was standing in line i past out moments before my head ache hit me.
Many ppl are telling me that i should move forward with this and sue not just for being injured but just for the medical care.
What do you think i should do?
Please no “dumb” answers… Thanks

  1. Hate to tell you man, but you won’t get anywhere trying to sue. They’ll act like you don’t exist. Now, did you try to go to the VA for treatment, or were you waiting for them to send you something in the mail? The VA is a tough nut to crack, and you have to submit requests and applications a few times before they look at it seriously. They reject everything the first time around, just on principal. You have to stay on them in order to get your foot in the door. I know from experience. I blew my knees out and still had to stay on them before I got any help from them.

  2. You may sue but it’s better for you to see a lawyer first to ask him/her to assess your case. Before you decide to sue, you need to consider and balance the legal costs that you will incur, the duration of the legal process (whether you can wait and be patience if the legal action takes a long time to settle) and the estimated amount of damages or compensation you will likely to get if you sue.

    If you need to expend a huge amount of moneys to pay the legal costs but you only get a small amount of compensation, then you need to consider whether its worth it.

  3. You will get better results working through politicians like your congressman and senators. What you need is both medical care and rehabilitation help. Complain enough to your congressman and senators, and you will see how the “squeaky wheel” gets attention.

  4. SHOULD YOU SUE THE MILITARY? That is a tough question. But according to your story you were hurt during some exercise or training in the Marine Corps. in 2006, what was the diagnosis of their doctors over there? You didn’t specify here. Bad headaches can be interpreted with so many symptoms. You might have some migraines long time ago during childhood so you cannot blame the training you had in the Marine Corps or could be something else. My firm advice is you must have second opinion of a doctor regarding your headaches. You must link the head injury of yours during your training otherwise you ain’t GOT NO CASE to sue for. Besides suing the Marine Corps is NOT EASY. This is a GOVERNMENT INSTITUTION longer than your folks or even our ancestors had ever been. It is like firing a BBgun over GODZILLA.

    What is the medical discharged for? What is the reason? Again you didn’t specify. What you only after is to get free 3 months of medical care at your local V.A. is it not? You are going to sue the Marines for this? You know what or how to sue? I guess not. It tantamount to time & money. Well if you are rich then I suggest you sue but if none I think you just forget about it. DO YOU HAVE LOTS OF TIME? It requires all your precious time going in and out of the court for this. Even to the brink of pissing or sleeping in the court room. BE GENTLE WITH YOURSELF I advice DON’T SUE. Do not bring problems with yourself. Bring your headaches to a finest doctor and let them examine you thoroughly and find out what is really wrong with you. THE MARINES CAN STILL BE AROUND EVEN IF YOU DIE. I doubt if you can do the same.
