I was hired by MGM November 09 and in June 10 had to ask for medical leave for knee surgery. My leave was for six months. My doctor refused to allow me to go back as a guest room attendant and wanted me to transfer to a different dept. so as not to re injure my knee. Employee relations told me to start applying for other departments before my medical leave was up. However, after many tries ,I only had two interviews and was not hired. I received a call from employee relations last week saying since I had not returned, I had to resign or face employee sanctions in front of a board for not coming back to work in the time frame. They told me I could never work at a MGM property again if I did not resign that day. I refused. I really wanted to return to work in a different department;I just did not want to crawl on my knee and had to have repeat surgery. If I am cut loose from them, Am I entitled to unemployment? Any info would be greatly appreciated.

Whatever you do don’t resign, you will not be able to draw your unemployment under these circumstances. You need to continue to make every effort to get into another department. Keep notes and documentation of dates, who you spoke with and jobs you applied for and interviews you had. You do need 3 quarters, 36 weeks of uninterrupted work to to be eligible — if you were working prior to Nov 09 and have been under a Dr.s care since June 2010 you should be OK with eligibility.
If you have not worked a full week, I would go ahead and apply for my unemployment benefits for that week and every full week that you don’t work. Continue to follow your Dr.s orders and continue to make every effort to keep your job, like your doing “sanctions” or not!
Follow these guidelines, important to keep written documentation, if you are terminated under these conditions, receiving your unemployment won’t be any problem.
