I just received a 25% disability rating in california for my left knee. I have been on workers comp for almost two years. I cannot return to my job as a journeyman painter. I am just wondering how much can i expect for a settlement (lump sum). Also will they retrain me to do something else? i just contacted an attorney today,but do i really need him?

You probably don’t need that attorney. Benefits are strictly defined by the state – so there’s no negotiations there. The only time attorneys are any good, is when either a. the insurance company denies the claim, and don’t think it’s work related or b. you disagree with the disability rating or c. if your employer didn’t have any workers comp in force, and you have to sue them for what you’re due.
Anyway. California has one of the most convoluted and difficult calculations, when figuring a settlement. There are charts, and you have to flip between them. They take your whole person impairment rating, and adjust for your loss of future earnings, your occupation group code, your occupation group NUMBER, which is separate from the group code, and your occupational variant – different than both the number and code. That’s adjusted for your age, and VOILA! You now have the settlement amount.
So there are TONS of variants, that go into the calculations.
