When a lawsuit is dragging on and on – over 7 years, and the administrative judge handling it has already decided the injured worker will get his workers comp – even made the insurance company pay up a little a few years in (a small one-time chunk he called a “good faith installment”, does the lawyer representing the injured party get financial help from some place to help pay fees while waiting for the settlement to finally occur? Just wondering because my lawyer doesn’t seem in any hurry to settle and doesn’t seem to speak up or push the insurance company into settling. I’m wondering why he isn’t anxious to settle and get his money, too. Everytime a settlement date is set, the opposing attorneys want a new doctor’s examination and than my doc wants one and this just drags on and on for years..

You may want to consult another lawyer. It is the insurance company that is dragging their feet. They will do that hoping you will just drop it. And workers comp is the worst. We had a case several years ago and the lawyer said no pay till we settle, but then 2 years later he told us he would start taking money out of our check from worker comp. they quit paying us a weekly benefit and the case settled shortly after. Yours has gone way to long and you are going to have to start putting a lot of pressure on your lawyer to settle or fire him and get a new lawyer then he should not get anything. Please consult another attorney or talk to Better Business Bureau. Don’t just sit back and take this any longer.
