Question by : I got fired yesterday from my job…Any comments?
I was fired from my job today, as a casual mail handler through USPS. I had started my job last Wednesday.

My left arm has been hurting the last two days. I might have strained or pulled a muscle in my left arm. I told my supervisor about it today, and I told him that I might not be able to use a specific machine for more than 5 hours, because of the pain in my left arm. He said “okay”.

Later, he called me to his office. He told me, that, the company has a zero tolerance policy, when it comes to reporting accidents/injuries late, and that he was going to have to “let me go” (fire me).

I told him, that, I was unaware about the “zero tolerance policy”, and if he could possibly just give me a “warning” this time, rather than firing me from the job. I was a hard worker, and I always did the tasks that I was asked to do.

He responded to me: “I know you do everything that you are asked to do, but, we have a zero tolerance policy. I am sorry, but, I am going to have to let you go”.

I had NO IDEA about the zero tolerance policy. I understand if it’s one of the company’s rules, but, it’s not like I had STOLEN anything……….
There were several reasons why I hadn’t told anyone sooner about my arm pain. For one reason, I was still able to perform many of the job duties, despite my arm pain. Second reason, I didn’t think any of the supervisors were going to take me seriously, if I had told them about my arm pain (for example, I felt, that, they might of said to me: “So what? You look fine to me….Continue working!!!). Third reason, I had told one of the workers yesterday about my arm pain (I think she might of been a supervisor, but I don’t know). Fourth reason, I thought the arm pain was only “temporary”, and it would go away after a short time.

I finally told my supervisor about my arm pain today, because, I realized that my arm pain hadn’t completely “healed” yet. Therefore, I thought, that, it would be better for him to know about it.

If I would have known about the “zero tolerance” policy, I would have IMMEDIATELY told my supervisor about my arm pain.

  1. Ignorantia juris non excusat or ignorantia legis neminem excusat (Latin for “ignorance of the law does not excuse” or “ignorance of the law excuses no one”) is a legal principle holding that a person who is unaware of a law may not escape liability for violating that law merely because he or she was unaware of its content.

  3. Did they give you any papers on the policy’s of the job and what not because if they didn’t bring it their attention because they can not fire you for something you had no idea of the rules pertaining to it.
on my personal note you should have notified them to it because if you injuried it on the job and it did never get better you would have to go through hell to get compensated. I am glad you are not too badly injured.

And you are not a slacker due to your job is PHYSICAL LABOR so ignore that person and ignorance of the law is true but a policy of a company is not a law so ignore them as well.

  4. YOU HAVE BEEN LIED TO!

There is no zero tolerance policy for reporting injuries late, there is a zero tolerance policy for Violating the FMLA or the Sick Leave.. The FMLA clearly states that you must not take advantage of the sick leave! But you did. Ot , you didn’t even take a leave , so there you didn’t violate any of their rules!!

By The Way , are you sure he said that you violatec zero tolerance policy because you see. The sick policy convers only if you are unable to do your job after a serious injury
And pulling a musleis not a serious injury!

Hence , You should demand your boss for the exact reason why you were fired and study these 2 sources i am about to give you and you will se for yourself that you did nothing wrong

Srry for the bad grammar i was typing from my mobile!
