Can I sue for this? (Malpractice)?
Question by Megan: Can I sue for this? (Malpractice)?
Don’t judge…here it goes. I had a surgical abortion at 5 weeks pregnant from Family Planning. I kept bleeding and had excruciating chest/back pain the following week and went to the ER multiple times. They found out that the surgery was unsuccessful and I was STILL pregnant; the pregnancy hormones caused acid reflux that burned my esophagus which caused the pain. A week later I went in for my 2nd surgical procedure (the same clinic/same doctor). After that, the bleeding worsened, I was in and out of the ER until they found that I still had a chunk of tissue stuck in me. They gave me a shot to try to push it out but it didn’t work. I had to go in for my 3rd abortion in less than a month (same clinic, different location). My ER bills are almost $ 20,000 and I am still unsure if that much surgery hurt my chances for future pregnancies. Plus the emotional trauma, missing a lot of college, and work….has been awful. I know my case is extremely rare, do I have the right to sue?

Future pregnancies????? What is the criteria for keeping your baby or killing it?
Whether you can sue or not will depend upon what the paper work says that you signed prior to the procedure. Some have joint or non-liability clauses that end any malpractice suit before it goes beyond filings.
You need to have a consultation with a medical malpractice attorney familiar with the laws of your state. Be sure to take copies of your paper work signed at the clinic with you. Never take the originals, you keep them at all times.
Be prepared to answer why you returned to the same clinic and doctor after experiencing malpractice the first time. That seriously weakens your case.
No way to know…what did you sign? Did you read it? Doubtful. Start there,
The only way to successfully sue would be to prove negligence on their part. That will be very hard to do. You certainly wrote nothing above that would show it.
