Question by bummed by the system: after missing work due a car accident my job fired me reason being i was not covered under FMLA what can i do?
the question at hand is this. i was employed by a major corporation (boeing) this is it i was in a car accident i was taken out of work due to the car wreck i sustained a few injuries. so i gave my employer my doctors note and he said everything would be fine. one week before i was to return back to work i recieved a letter from my employer stating that i was not covered under the family medical leave act or fmla so they basically fired me and left me with no employment so my question is what can i do. i still have the original doctors note and the note they sent me stating i have been fired.i have a job now that pays like seven dollars an hour less than my former salary i had to take the job to support my family. i just think i got the short end of the stick

file for unemployment, appeal their denials and eventually you will win

You definitely have a case for unemployment, but the underlying question is “How do I get my job back?”
Look at other circumstances surrounding the absence. FMLA would have covered your absence, as long as you met the number of hours worked. You need to find that out. If there are other circumstances, like you failed to call off from work for two or three days before you showed up with the Dr’s excuse…or perhaps had too many absenses prior to this one.
Regardless, you need to consult a lawyer with all of the facts. He will advise you as to the proper recourse. If you are uncomfortable with a lawyer, then you need to go through the Boeing appeal process, which is available through corporate Human Resources. If they refuse that, make sure they refuse it in writing….and take that to the lawyer.
