Question by William: About to settle a workers comp case, can I include price of future surgery?
I was told I either settle the case or get a spinal fusion, I really don’t want to get the spinal fusion right now and wanted to wait until my back got worse, which I was told it would. If I were to settle would i be able to ask for the price of the surgery be included in case I want to get the surgery in a couple years.
Ok, so then my best bet is to just get the surgery now, unless they offer enough to cover it.
Will do Pat, it’s been two years since it happened and was told I can longer go back to the type of work I’ve done since I was 13, so it should be a good amount

No one can force you to make that choice.

You can tell them to go fuuuuck themselves.

If you want to settle, decide on a lump sum PLUS any related future medical expenses.

  1. You need to keep in mind that the workers comp is trying to minimize the cost to themselves and not take care of you. If you settle, then you settle. You’ll have to abide by that agreement come what may in the future. You need to make sure that everything you want is in the agreement and that’s so hard to foresee. There’s no real point in waiting for the fusion. If it going to happen it’s going to happen and waiting and possibly losing the insurance to cover it may not be in your best interest.
