Question by alan p: a person doing construction on my property hurt himself and is threatening to sue?
but the injury was not at all my fault. while working with concrete in shorts, he forgot their was a chemical that can burn the skin. plus the injury was purely cosmetic and did not at all effect his ability to work. also, he told me he was a licenced contractor (turns out he wasn’t). This happened over six months ago and i know he has been working just fine all this time. i happen to know he is just desparate for money right now. if he does have a case against me, what would you guess a ballpark figure to be? 5k? 10? 20? more?

zero… he doesn’t have a case. Most attorneys wouldn’t even take a case like this.

  1. Call the board of consumer affairs and tell them he is not licensed, and that he has threatened to sue you over a superficial injury. They will go after him. He will not get away with this. Even if he could sue you , your homeowners insurance should take care of it. If he bothers you again, ask to see his license, and tell him you are going to report him to the license board. I guarantee you will never hear from him again. He can get a stiff fine, and go to prison for up to 5 years if he is not licensed.

  3. Please do not be bullied into giving him money ! It is a tactic that works for him when he encounters old people that are timid etc.,
    From now on make sure you hire only people who are legit and have license and insurance and make them show it to you .
    Call his bluff .

  4. if he provided you with a contractors lic. # you should have looked into it to cover your *#* ! It sounds like he wasn’t due to the fact that he got injured on something that he should have knowen about. Sometimes we get what we pay 4.
