11. Who do I sue—the insurance company or the driver that hit me?
a. Under Indiana law, the claim will be filed against the person who is responsible for the negligence, most likely the driver of the vehicle. Their insurance company is not named as a party to the case. There may also be other persons named as defendants, such as the negligent drivers employer if he/she is on the job at the time of the incident.
