A very good question. While the actual time frame of the clip is short, the question is well thought out which took a really long time.

How can Obama/Congress raising taxes on your employer be good? http://workers-comp-rights.com/general/how-can-obamacongress-raising-taxes-on-your-employer-be-good/ http://workers-comp-rights.com/general/how-can-obamacongress-raising-taxes-on-your-employer-be-good/#comments Sat, 19 May 2012 22:17:01 +0000 WcrAdmin http://workers-comp-rights.com/general/how-can-obamacongress-raising-taxes-on-your-employer-be-good/ Question by Monkey Pig: How can Obama/Congress raising taxes on your employer be good?

http://www.washingtonpost.com/wp-dyn/content/article/2009/02/21/AR2009022100911_pf.html

We pay half of your S.S, half of your Medcare, unemployment insurance, workers comp insurance, liability insurance, auto insurance, property insurance, accountants, electric bill, water bill, gas bill, we have to pay you, we have to pay licensing fee’s occupational fee’s, local business fee’s per town/county fee’s, permits, maintain vehicles, office supplies, on and on. Raise taxes on business? If you are a Lib, you voted yourselves right out of a job. He wants to close loopholes? We need those loopholes to stay in business, and keep people EMPLOYED.
I am talking small biz 70% of all job providers, not big corps.
Hey uneducated, “your fat” the current S.S. rate is 12.4%, 6.2% comes out of your check, your employer pays the other 6.2%

Would my damages be frivolous and hurt me, I can prove them? http://workers-comp-rights.com/general/would-my-damages-be-frivolous-and-hurt-me-i-can-prove-them/ http://workers-comp-rights.com/general/would-my-damages-be-frivolous-and-hurt-me-i-can-prove-them/#comments Sat, 19 May 2012 21:17:02 +0000 WcrAdmin http://workers-comp-rights.com/general/would-my-damages-be-frivolous-and-hurt-me-i-can-prove-them/ Question by Joe B: Would my damages be frivolous and hurt me, I can prove them?
I’m going to small claims court suing my landlord. My landlord breached my lease on my move day with my stuff practically on his door step he tells me he has to breach the lease, due to negligence on his part.

He’s deformed his character because he never returned my security deposit, once he breached and didn’t deliver the premises that money was instantly owed to me. He waited 3 weeks to mail it to me and the check bounced and I got charged additional money as well as losing my deposit. I informed him and it’s been 2 months since the breach he still hasn’t given it to me, he’s stating he’s going threw financial hardship with my own money eh.

I’m suing him for my temporary living expenses, I never was able to find a new place because I don’t have additional funds to pay a new deposit and first months rent. Most people will ask why you didn’t just find a new place. Because I didn’t have the money because my original deposit was illegally being withheld.

I had to move back home because I my deposit wasn’t given back to me, and I was given 0 days notice… the contract was breached on my move in day. There was massive negligence on my landlord’s part.

I’ve had my lease reviewed there were no provisions that would allow him to do this the lease was very basic.

I had to move back home which is 1.5 hours from my work. I’ve been commuting to work each day Mon-Fri driving 3 hours round trip and putting 150 miles on my car daily. Previously I lived 2 blocks from where I lived. I’m wondering if I can sue for my time loss driving every day and the mileage on my car. I’ve spent about 60 hours of my time driving and put about an additional 6k mileage on my car all because of his negligence. I understand ordinarily my landlord wouldn’t be responsible for these damages but since I was given no notice of a breach, and his check bouncing and never giving back my deposit his character is deformed big time, my landlords a total scumbag who spent my deposit.

Could I possibly be awarded these additional damages because of his massive negligence and because these damages were unavoidable because I was given no notice, and my deposit was never returned to find additional housing… rather his check bounced and he never fixed the situation.

Is this possible or will it make my suit look frivolous? These damages were unavoidable at the time of the breach given I had no deposit returned, and I was given 0 days notice.

For all you people who say the landlord owes nothing but my security he broke a legally binding contract. A contract in which there were no provisions protecting him from paying damages if he broke the contract. He has illegally withheld my security deposit for 2 months when he had 5 days to return it, he spent it and is claiming he can’t return it now because he’s going threw financial hardship with my own money.
I had this lease in place for 3 months prior to my move in and paid my deposits at signing. He waits until my move in day to say he can’t allow me to move in, insult to injury he spent my deposit money and to this day has not returned it.

Most states allow for consequential damages when the landlord fails to make the rental available when dictated by contract. Depending on the state you reside in, you have full right to sue for everything that you have and actually even for more.

I would suggest you review how you will present this to a judge, because some of the things you say here will not hold up as presented. You have to show harm, not simply state you were harmed. Even though a landlord violates the terms or even the law, unless you can establish and prove how it harmed you it will likely be dismissed. Start thinking in terms of costs to you for these actions. How much did gas, wear and tear on your car cost? How much loss wages did you have? Start adding these costs up, itemize them and give it to the judge during court.

Hey dudes- Happy Easter!!!!!? http://workers-comp-rights.com/law-ethics/hey-dudes-happy-easter/ http://workers-comp-rights.com/law-ethics/hey-dudes-happy-easter/#comments Sun, 20 May 2012 03:53:00 +0000 WcrAdmin http://workers-comp-rights.com/law-ethics/hey-dudes-happy-easter Hey dudes and ladies!

Hey- Happy Easter!

Hey- does anybody have some money they could give me? Right now, things are tough all over for me.

I am ready, willing, and able to work. I had a job until four weeks ago, working for a Worker’s Comp attorney. He had to let me go, because he could not afford to pay me any longer. It’s just a small practice.

I and my family are suffering. We have no money for food, medicine, and our basic needs. My Mom is not working, because she has Carpal Tunnel injuries. My step dad is working, but he makes approximately 1K per month.

I am indeed receiving SSDI due to OCD, but it’s not much. I am getting less than 750 per month. I have applied for food stamps, but they have not set an appointment yet for me to come in. I am praying about this, but as I said before, things are so hard.

I just applied for a job at Office Depot on Friday. But in the meanwhile, I have no choice but to sit and wait.

Can you help me? Thanks- God bless you.

If my church wrecked my car and has never taken responsibility, can I sue them? http://workers-comp-rights.com/general/if-my-church-wrecked-my-car-and-has-never-taken-responsibility-can-i-sue-them/ http://workers-comp-rights.com/general/if-my-church-wrecked-my-car-and-has-never-taken-responsibility-can-i-sue-them/#comments Sat, 19 May 2012 20:17:01 +0000 WcrAdmin http://workers-comp-rights.com/general/if-my-church-wrecked-my-car-and-has-never-taken-responsibility-can-i-sue-them/ Question by Gina D: If my church wrecked my car and has never taken responsibility, can I sue them?
I worked for a church,.. Okay, the name of it will remain nameless, (unless you become interested..)
so anyways, I worked for a church and lent them my car while I went on vacation, and it was TOTALED when I came back.
they have hurt me soo much, disrespected me and not helped me AT ALL.. with this situation.
It is not okay to make me feel badly, but that’s what they did..
my question is can I sue a non-profit organization?
because they are telling me I cannot.
But I do not believe this.
thanks.
Like small claims court, is what I mean.
no, not FULL coverage, I didn’t have.
and the church is an organization, who DOES NOT have insurance and gave someone at the church a mission to drive my car, and didn’t have insurance.
this is WRONG very WRONG that noone took responsibility for my car. the person who CRASHED it didn’t have insurance, and got away, and the individuals didn’t take responsibility… blaming that they don’t have a lot of money.
my dad believes the CHURCH should take responsibility, since they were on CHURCH business.

you could sue but you most likely would not win. When you’re not working, start looking for another job. Chances are he just doesn’t like you or your group of friends so he is going to make a reason to get rid of you.
