Filed Chapter 7, I am on workers comp, Can I lose my settlement?

Today my wife and I had our meeting with the Trustee and he said that I needed to file section C for my workers comp claim and make it exempt so when it comes time for my settlement it wont be taken away. Has anyone had to deal with this before? because I have no idea how to amend the petition. I called the bankruptcy court but they said they could not give any information. Can somebody help me? I am residing in California. First person to give me the correct and true answer gets 10 bucks via Paypal!!

  1. You probably need a free consult with a lawyer to ask about this, OR, ask the adjuster handling the claim.

    The workers comp, since it’s ONLY lost wages and medical payments, should be exempt from bankruptcy court. After all, this is the money the insurance company is paying you now, to cover your future medical bills related to this injury.

  2. Keep your money, and call an attorney. As you are not familiar with
    the BK process, it’s appearantly not a DIY project for you and your
    wife. The BK court can’t give you information on this as it’s a
    legal proceeding and they, nor are posters here, attorneys.
